Mizel Hozal - Legal Terms and Conditions
1. Acceptance of Terms
- By downloading, installing, accessing, or using the "Mizel Hozal" Android application (hereinafter "the App"),
you (the "User," either buyer or seller) agree to be bound by these Terms and Conditions. If you do not agree to
these Terms and Conditions, please do not use the App and do not proceed to any of the next steps within the app.
2. App as an Intermediary
- "Mizel Hozal" operates as an intermediary platform connecting sellers and buyers for the purchase and sale of
goods. The App facilitates transactions but does not directly sell or deliver products.
- From this point onwards "Shop" will mean any entity (individual, proprietorship firm, partnership firm, private limited company, public limited company etc.) that is allowed to sell different eligible products through this app's in-built framework.
- From this point onwards "Buyer" will mean any entity (all registered users - including "Shop", within this app) who can buy any product through this app's in-built framework.
3. Escrow Service
- "Mizel Hozal," owned and operated by proprietorship concern "Mizel Hozal", registered address: Mohan Puri, Jail
Road, Opposite to Jail Mosque, Tabalchari, Rangamati - 4500, will act as an escrow for all transactions made
through the App.
- Upon a buyer's purchase, the payment amount will be held securely by "Mizel Hozal" until the order is delivered
and confirmed by the buyer.
- If the order is not delivered within the agreed-upon timeframe commonly known as the delivery period, the buyer may
request a full refund through the App.
- "Mizel Hozal" is responsible for the safekeeping of the buyer's funds during the escrow period.
4. Seller's Responsibility
- The seller is solely responsible for packaging, shipping, and delivering the purchased products to the buyer.
- "Mizel Hozal" does not handle or arrange for product delivery.
- The seller is responsible for providing accurate delivery timeframes.
- In addition to, and not in limitation of, the terms herein, sellers are bound by the obligations and
responsibilities outlined in the separate "Seller Agreement" with "Mizel Hozal".
5. Dispute Resolution
- In the event of a dispute between a buyer and a seller, both parties are encouraged to communicate and attempt to
resolve the issue amicably.
- If an amicable resolution cannot be reached within a reasonable timeframe, either party may escalate the dispute
to "Mizel Hozal".
- "Mizel Hozal" will investigate the dispute and make a final and binding decision based on the evidence provided
by both parties.
6. User Accounts
- Users are responsible for maintaining the confidentiality of their account credentials.
- Users must provide accurate and complete information when registering an account.
- "Mizel Hozal" reserves the right to suspend or terminate user accounts for violations of these Terms and
Conditions.
- "Mizel Hozal" maintains a separate Privacy Policy for its users. Read it here.
7. Prohibited Activities
Users are prohibited from:
- Engaging in fraudulent or illegal activities.
- Providing false or misleading information.
- Violating any applicable laws or regulations.
- Attempting to disrupt the proper function of the App.
- Using the app for any malicious intent.
- Users who perform any prohibited activities will not be eligible for any terms and conditions outlined in this agreement. "Mizel Hozal" reserves the right to take any appropriate decisions or actions in any cases arising from the use of the app.
8. Delivery of products:
- "Ready Products": Ready products are those product which are ready for immidiate shipment to the customer.
- "Ordered Products": Ordered products are those product which needs additional order preparation time for completion to its ready state for immidiate shipment to the customers. Ordered products will be identified explicitly through their descriptions via the phrase - "Ordered Products" and through the final checkout button captioned as "Place Order".
- For "Ready Products" purchased directly from our "Mizel-Hozal" shop:
- Within Rangamati: Delivery will occur within 7 working days.
- Outside Rangamati: Delivery will occur within 10 working days.
- For "Ready Products" for other shops selling through this App: If a shop hasn't explicitly stated its own delivery period, the same timeframe will apply:
- Within their home district: Delivery within 7 working days.
- Outside their home district: Delivery within 10 working days.
- For "Ordered Products": Additional order preparation days which will be explicitly mentioned in product page/description will be added to the delivery period as mentioned aboved and once the ordered products become ready products, standard days of delivery will be applicable as above.
- For "Cash on Delivery" (COD) method:
- The buyer is required to pay the full shipping charges upfront. Purchases placed via the COD method without the shipping charges being paid will not be processed and will be considered unconfirmed. Unconfirmed purchases do not guarantee product availability for the buyer.
- Any purchase made via the COD method is considered an incomplete purchase until the final payable amount is settled upon delivery of the product. If a buyer fails to complete the purchase by paying the final amount in Cash upon delivery, the upfront shipping charges paid will be forfeited and will not be refunded to the buyer.
- COD purchases will be delivered via Third Party individuals, partners, businesses, or companies authorized to collect the cash on delivery of the product by the seller.
- Delivery of products will be performed via third-party individuals, partners, businesses, or companies. Delays on their part in fulfilling normal delivery duties will not make the seller or Mizel-Hozal liable.
- For "Cash on Pickup" (COP) method:
- Available for products in shopping cart from only a single shop. If a cart containes products from more than a single shop, this option will not be available.
- Avalilable for products priced above Tk. 200.00. The buyer will pay a booking money of Tk.200.00 upfront to reserve the product till the end of next working day.
- For buyers who will purchase products from the relevant shop front premises and will pay full amount of the purchase product in cash will not be required to pay the above booking money of Tk.200.00
- Within next working day, the buyer will arange to pick-up the booked product by paying rest of amount in cash in full from the relevant shop store front. Any purchase made via the COP method is considered an incomplete purchase until the final payable amount is settled upon delivery and pick-up of the product. If a buyer fails to complete the purchase by paying the final amount in Cash upon Pickup, the upfront booking money of Tk.200.00 paid will be forfeited and will not be refunded to the buyer.
- Shipping charges will not be applicable for any purchases made through COP method.
- Delivery of the product is instant or within next working day as the buyer collects the products from store premises.
9. Returns and Refunds
9.1. Returns:
- Definition: "Return" henceforth will mean the process of returning the sale items considered as final sale and purchased item which meets the return eligibility criteria mentioned below. It does not mean refund of monetary value. However, store credits in the form of "Coins" will be issued which can be used to purchase other items.
- Eligibility: To be eligible for a return, your item must be:
In its original condition
Unworn, undamaged, or unaltered
In its original packaging and purchased from the Shop "Mizel-Hozal" from our app.
- Return Process:

- Shipping: You will be responsible for the cost of return shipping. We recommend using a
trackable shipping service. Please ensure the return package is securely packed to prevent damage during
transit.
- Return Processing: Upon receipt of your returned item, we will inspect it to ensure it meets
the return eligibility criteria as mentioned above. Once verified, we will issue a store credit to your Mizel-Hozal account in the form of "Coins" which will be considered as monetary benifit out of the return process.
- Important Notes:
No Cash Refunds: Please note that we only offer store credit for returns.
- Sale Items: Sale items are final sale and cannot be refunded but can be returned if it meets the return eligibility criteria as mentioned above.
- Damaged or Defective Items: If you receive a damaged or defective item, please contact our customer support
immediately within first 24 hours of receipt of the product along with video documentation of the package opening for submission
as evidence. We will arrange for a replacement or initiate the return process.
- Please retain your original order confirmation as proof of purchase.

9.2. Refunds:
- Definition: "Refund" henceforth will mean the process of returning the monetary value which meets the refund eligibility criteria mentioned below.
- Eligibility:
- Refunds will not be issued unless the buyer initiates the process of refund through the app within purchase protection period. After the purchase protection period is over, refund request will only be entertained as per following manner.
- Purchase protection period is an additional determined period of time in addition to the declared delivery period. Purchase protection period will be mentioned in the "Order Details" page after a purchase is complete.
- Refunds will be issued to buyers when a seller fails to deliver items within the mutually agreed upon timeframe. The delivery timeframe can be extended upon mutual agreement with the buyer on occasion of delay in delivery due to reasonable causes for the items on transit by the courier company.
- Refunds will not be issued if the buyer receives an item which meets the product's description.
- Refunds will be issued when the buyer receives an item that is significantly different from how it was described
by the seller.
- Refunds will be processed upon receipt of the returned item from the buyer by the seller, provided it is in its
original condition, free from damage, use, or physical modification by the buyer following careful package opening for
initial inspection.
- The buyer will retain video and optional photographic documentation of the package opening for submission
as evidence in refund requests.
- If the buyer does not himself initiate a refund request through the app within purchase protection period, the
purchased product will be deemed as delivered as described, and any subsequent refund requests afterwards will be only
entertained and processed after submission of sufficient proofs and upon our complete investigation process is
over.
- Legitimate refund requests received from the buyer through the app will be processed but not limited to be
completed within next 7 days and will be handed over to the relevant third party payment gateway service
provider for final execution through which the original transaction took place.
- Refund process may incur additional transaction charges by the relevant third party payment gateway service
provider which will be borne by the buyer.
- Final execution on the part of the third party payment gateway service provider will
not be the responsibility of "Mizel Hozal" and no legal bindings will be forced on "Mizel Hozal" in this regard due to delay in payment or difference in value of payment.
10. Limitation of Liability
- "Mizel Hozal" shall not be liable for any damages arising from the use of the App, including but not limited to
direct, indirect, incidental, or consequential damages.
- "Mizel Hozal" is not responsible for the products sold or the sellers' actions.
- "Mizel Hozal"'s liability is limited to the amount of the transaction held in escrow.
11. Changes to Terms and Conditions
- "Mizel Hozal" reserves the right to modify these Terms and Conditions at any time.
- Users will be notified of any
changes, and continued use of the App constitutes acceptance of the modified Terms and Conditions.
12. Governing Law and Applicable Jurisdiction
- These Terms and Conditions shall be governed by and construed in accordance with the acting laws of Bangladesh.
- Any and all legal actions or proceedings arising out of or relating to this agreement and all buying or selling
activities conducted through the app shall be exclusively instituted and prosecuted in the Court of the District
Judge, Rangamati.
13. About Us
- "Mizel-Hozal" - initially a fashion boutique house - was established on April 18, 2015. "Mizel-Hozal" ( a Chakma word for "Blending") does what its name suggests. It blends & fuses different styles, techniques and available, both traditional and non-traditional, raw-materials found in Chittagong Hill Tracts (CHT) and around the country. "Blending for the Best!!!" is the motto that we held at our core. The logo of Mizel-Hozal spells "Mizel-Hozal" in Chakma Scripts an in middle of the logo the symbol represents a strong flavor and taste of blending. Mizel-Hozal is a proprietorship concern owned by Ms. Tori Chakma. Now, Mizel-Hozal app has brought opportunities to experience different products of its mother entity "Mizel-Hozal" - the boutique house to its prospective customers along with other vast number of authentic different products offered by other different shops allowed to sell through this app.

15. Disclaimer of Warranties
- The "Mizel Hozal" app is provided "as is" and "as available" without any warranties of any kind, express or
implied. "Mizel Hozal" does not warrant that the app will be uninterrupted or error-free.
